MK files an urgent application with the ConCourt to halt the first sitting of parliament.

The Constitutional Court has received urgent filings from the uMkhonto weSizwe (MK) Party, requesting an injunction against the National Assembly’s first session, scheduled for this Friday in Cape Town.

The first sitting must occur within 14 days of the election results being announced, at a time and date decided by the Chief Justice, as per Section 51(1) of the Constitution. In an attempt to contest the legitimacy of the results of the general election in 2024, the party wrote to the Chief Justice and the Secretary to Parliament on Friday, requesting a postponement of the first meeting of Parliament.

According to MK, if the first sitting’s 58 members were absent, a quorum would not have been reached. The MK Party filed a lawsuit in response to their continuous complaints over the election outcomes.

The party’s attorneys have already demanded in writing that the first session of Parliament be stopped, addressed to Chief Justice Raymond Zondo and the Secretary of Parliament.
